Terms and Conditions

These Terms and Conditions (“Terms”) govern access to and use of the JewelValu website, web application, mobile applications and related services (“Service”). The Service is operated by Prosys Technologies (“JewelValu”, “we”, “us” or “our”). By creating an account, purchasing a subscription or using the Service, you agree to these Terms.

1. Eligibility and account authority

You must be legally capable of entering into a binding agreement and, when using JewelValu for an organisation, authorised to accept these Terms on its behalf. You are responsible for keeping login credentials confidential, restricting access to authorised persons and promptly informing us of suspected unauthorised use.

2. Nature of the Service

JewelValu is a software tool for preparing, storing and exporting jewellery valuation records. It does not itself inspect jewellery, verify purity, certify ownership, provide legal or tax advice, or replace the professional judgement of a qualified valuer. You remain solely responsible for measurements, rates, descriptions, calculations, customer information and every report issued through your account.

3. Trials and subscriptions

New valuer accounts may receive a time-limited trial. Continued creation or modification of records after the trial requires a paid or complimentary subscription. The available paid plans are ₹999 per month plus applicable GST and ₹9,999 per year plus applicable GST, unless a different written quotation applies.

Paid subscriptions renew automatically through the selected payment method until cancelled. Prices, taxes and billing frequency are displayed before authorisation. We may change future pricing by giving reasonable notice; a price change will not retrospectively alter a completed billing period.

4. Payments, taxes and cancellation

Payments are processed by an authorised third-party payment provider. You authorise recurring charges according to the chosen plan and are responsible for keeping payment information current. Applicable GST and other taxes are charged as required.

You may cancel automatic renewal from the Subscription page. Unless otherwise stated, cancellation takes effect at the end of the current paid billing period and access continues until then. Cancellation does not automatically create a refund. Refund eligibility is governed by our Refund Policy.

5. Permitted use

You may use the Service only for lawful jewellery valuation and related business purposes. You must not misuse the Service, attempt unauthorised access, interfere with security or availability, upload malware, scrape the Service, reverse engineer protected components, resell access without written permission, or use it to create fraudulent, misleading or unlawful reports.

6. Customer data and uploaded content

You retain responsibility for data and images uploaded through your account. You confirm that you have a lawful basis and any required consent to collect, store and process customer details, jewellery images and documents. Do not upload unnecessary sensitive information. You grant us a limited right to host, process, back up and transmit your content only as needed to operate and support the Service, as further described in our Privacy Policy.

7. Security and backups

We use reasonable technical and organisational safeguards, but no internet service is completely secure or continuously available. You should maintain suitable copies of important reports and source records. Notify us promptly if you become aware of a security incident affecting your account.

8. Intellectual property

JewelValu, its software, branding, designs, templates and documentation are owned by or licensed to Prosys Technologies. Your subscription provides a limited, non-exclusive, non-transferable right to use the Service during the authorised period. No ownership rights are transferred to you.

9. Third-party services

The Service may rely on payment gateways, email providers, hosting platforms and other third parties. Their services may be governed by separate terms and may occasionally be unavailable. We are not responsible for third-party acts beyond our reasonable control.

10. Suspension and termination

We may suspend or restrict access for non-payment, security risk, unlawful activity, material breach of these Terms or conduct that could harm the Service or other users. Where reasonably possible, we will provide notice and an opportunity to remedy the issue. On expiry or suspension, the account may become read-only so existing records can still be viewed or exported, subject to lawful retention and operational limits.

11. Service availability and changes

We may maintain, improve or modify the Service from time to time. We do not guarantee uninterrupted or error-free operation. Planned maintenance and urgent security work may temporarily affect access.

12. Disclaimer and limitation of liability

To the extent permitted by applicable law, the Service is provided on an “as available” basis. We do not warrant the commercial value, legal acceptance or accuracy of any valuation report created from user-supplied data. We are not liable for indirect, incidental, special or consequential loss, loss of profit, loss of opportunity or decisions made using a report. Our aggregate liability relating to the Service will not exceed the subscription fees paid by you for the three months immediately preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded.

13. Governing law and disputes

These Terms are governed by the laws of India. The parties will first attempt to resolve a dispute in good faith by written communication. Subject to applicable consumer rights and mandatory law, courts in Bengaluru, Karnataka will have jurisdiction.

14. Changes to these Terms

We may update these Terms when the Service, pricing or legal requirements change. The current version and effective date will be published here. Continued use after an update takes effect constitutes acceptance of the revised Terms.
